Getting Papers in Spain for South Americans

I was asked today if I knew the answer to this question about getting legal papers for South Americans.

My friend has a South American girl that cleans for her and she pays cash like everyone.  The cleaner has been trying to get papers and before you needed to have a offer of contract to get your legal papers.

Now apparently this has changed and now they just need a signature and NIE Number of where they work and how many hours from the Employer.

But what effect does this have on the Employer?  If any?

We have spoken to the departamento extranjero and they are not aware of any changes. It is possible that sometimes very recent changes take a little while to filter down however!!!

As far as we are concerned South Americans need to apply before entry for a Visa...

1. A tourist Visa lasts 3 months, after which if they have no residencia Visado they must leave.

2. Apply for a residencia visado with a work contract from employer.
